Terms of service
These terms cover your use of Redback Feedback during its invite-only beta. The service is operated by Kieran Block Pty Ltd (ACN 101 376 587), referred to here as "we" or "us". By accepting an invite and using the service, you agree to these terms on behalf of your organisation.
1. It is a beta
- The service is provided as is and as available. We do not promise that it will be uninterrupted, error-free or suitable for any particular purpose.
- Features may change, be added or be removed while we learn what works. We will give notice of significant changes where we reasonably can.
- We may end the beta, or your part in it, at any time. If we do, you will have a reasonable opportunity to export your data first.
- There is no charge during the beta. If that changes, we will tell you before anything is billed.
2. Your account
- Access is by invitation. You may not share an invitation or create accounts for people outside your organisation.
- Keep your sign-in details and API keys secret. Anything done with your account or your keys is treated as done by you. Tell us promptly if a key is exposed so it can be revoked.
- You are responsible for the people you add to your organisation.
3. Acceptable use
You must:
- have a lawful right to contact the people you send feedback links to, and comply with the Spam Act 2003 (Cth) and any other law that applies to your messages;
- only collect information you are entitled to collect, and tell respondents what you are collecting and why, as the Privacy Act 1988 (Cth) requires;
- not collect sensitive information (such as health, religion or political opinions) without the respondent's consent and a lawful basis.
You must not:
- send spam, bulk unsolicited messages or anything misleading, using links or buttons from the service;
- use the service to harass, deceive or harm anyone, or to collect information for an unlawful purpose;
- upload or request content that is unlawful, defamatory or infringes someone else's rights;
- probe, scan or attempt to break the security of the service, or interfere with anyone else's use of it;
- resell the service or present it as your own product without our written agreement.
4. API fair use
The API and the MCP server are there for you to automate your own feedback work. Use them at a volume that a real feedback workload needs. We may apply rate limits, and we may ask you to change an integration that puts unreasonable load on the service. Do not use the API to scrape or mirror data that is not yours.
5. Your data
- Forms, responses and attribution values you collect belong to your organisation. You give us the permission we need to store and process them in order to run the service, and no more.
- You are responsible for the questions you ask, the data you attach to links, and what you do with the answers.
- We handle personal information as described in our privacy policy. For respondent data we act on your instructions as a processor.
- You can export your responses as CSV and delete responses, forms or your whole account at any time.
6. Suspension
We may suspend or end your access if we reasonably believe you have breached these terms, if your use puts the service or other customers at risk, or if we are required to by law. Where it is practical and safe we will tell you first and give you a chance to fix the problem.
7. Liability
Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, or loss of data arising from your use of the beta, and where a guarantee cannot be excluded our liability is limited to supplying the service again. You indemnify us against claims arising from your breach of section 3.
8. Governing law
These terms are governed by the law of New South Wales, Australia. Any dispute will be dealt with by the courts of New South Wales.
9. Changes and contact
We may update these terms as the beta develops. We will update the date at the top and flag material changes in the dashboard. If you keep using the service after a change, you accept the new terms. To contact us about these terms, use the invite form on our home page.
